special edition of "hannity." there was no indictment or arrest of former president trump this week. they wanted it so bad. it might be because d.a. alvin bragg's case is falling apart. that's what jonathan turley argues in his column for the "new york post." he writes that bragg is looking for a crime to pin on trump this whole time just like he promised. it's about get trump. here to explain more is jonathan turley. is it that more time revealed what a weak case it is and they had to delay? if they are delaying it, how does that help their case? >> well, the sad thing, pete is that the weakness of this case was clear all along. the department of justice declined to bring federal election charge against donald

trump. bragg's predecessor did not bring this kay yow -- case. bragg himself threw a flag on this case leading to two prosecutors resigning. they forced bragg to take this step. what he is trying to do here is unprecedented under the statute. bootstrap a federal crime using a new york misdemeanor that has expired. you have to bring this misdemeanor charge within 2 years. it's a dead charge. the only way to resuscitate it is to prove a federal crime in state court. many including on the left say this is a bridge too far. >> pete: past the statute of limitations to start. trying to pin a federal charge on a state charge where he doesn't have jurisdiction. do you think the grand jury are saying this doesn't add up?

i see other documents and hearing other parts of this? >> the grand jury may have had a rude awakening when the attorney representing michael cohen that contradict cohen. cohen sold his flexible ethical standards who whoever will hire him. he left quite a trail including with this attorney. what bragg has to ask themselves where he is the champion of the rule of law or its nemesis using it for political purposes. this is the weaponization of the criminal justice.

it's propelled by politics rather than the law. >> pete: why would this information have been introduced so late? because they wanted the indictment and would deal with it in court? why introduce it now? >> nothing about the trajectory of this case makes sense. it was halted. the prosecutors going public. none makes sense except one thing. that's the politics. bragg thought the politics was on his side even in the law was not. >> pete: still a chance he brings it? i want to be first even if it gets dismissed? >> i think there is. he may make history being the first to indict a former president. it will be an infamous moment in the long run. i don't think history will be kind to this effort. >> pete: he would bask in the

love of the left even if it was rejected. a sad state of affairs. jonathan turley, thank you. also breaking today a prejudice with suspicious white powder and a death threat against alvin bragg was reported to be delivered to his office this morning. let's bring in the author of "trial of the century," gregg jarrett. on the new aspect. getting reports that the white powder was not dangerous but came with a death threat. does this have an impact? >> no, it doesn't. it sad and tragic and should every happen. nobody should ever threaten a district attorney or public official or anyone with violence. it's inappropriate and wrong and a crime. i hope they catch whoever did and prosecute that individual.

doesn't affect the merits or lack thereof of this case. >> pete: you heard jonathan turley. he said i can't wrap by brain around this making sense. is that correct? this is a political witch hunt? >> it is. bragg and his predecessors spent years and unlimited resources to scour through tens of thousands of personal and business records of donald trump in search of any kime. they could understand find any -- crime. they made one up. took this dubious misdemeanor and super charged it into a felony. can't be a state finance crime

because it was a federal election. it can't be under federal law because this is a local prosecutor who can only charge under state law. the cancellation of the suggests that the grand jury wised up and realized that bragg has been hiding exculpatory evidence and snookering them into believing that michael cohen can be trusted. in fact he went to prison because of perjury. seasoned experienced prosecutors in the d.a.'s office are undertaking the equivalent of a revolt saying you can't do this. the law didn't support it. neither to the facts. you are political.

it is outright unethical. the record reflects based on the assistant d.a. who resigned that they targeted trump because they didn't like his political beliefs. they didn't like him and thought he was a threat to the nation. my lord. it's a breach of legal ethics. it's the duty of the prosecutor to see that justice is done fairly. not to target someone because you don't like them or their views. that's the kind of thing over which lawyers get disbarred. >> pete: the other assistant district attorneys are saying do i want to be part of this? there should be nothing political about the law but this guy ran on get trump.

chuck schumer declined to say whether he supports this. could the politics cut against alvin bragg? >> i think so. his name will go down in infamy if he continues to pursue this case. i think even thoughtful people of all political stripes recognize this for what it is and recognize bragg for what he is. a fool for even thinking about trying to pursue this absurd legal theory that has no basis in the law. i would also think and hope that a judge would say i won't let this go to a jury. i can't allow this to move forward. motion to dismiss granted. >> pete: yes. a light weight who will go downs with an aster itch.

what we know it happened near uvalde, texas. 80 miles west of san tan toneio. -- a 9-11 call came in from an unknown caller. according the police statement they said undocument immigrants were suffocating inside a train car. police found at least 15 immigrants in need of medical attention. we understand 5 were flown to san antonio and 5 taken to nearby hospitals. two of those undocumented immigrants were pronounced dead at the scene. that's what we know so far. two inside that train car

declared dead at the scene upon at least ten others have been taken to hospitals. police still on the scene there. we have seen many times over the past few years illegal immigrants using these train cars that come in from mexico in many cases, carrying cargo. they board those train cars and try to use them to get further into the interior of the united states. this appears once again to be the tragic consequences of those kind of efforts by these illegal immigrants. tonight at least two confirmed dead. at least ten confirmed to need hospital treatment. >> pete: suffocating in a train car. nothing humane about that. thank you very much. in case you have not noticed, joe biden loves to spend other people's money.
